Justification for absence from Brazil for more than 2 years
The granting of a residence permit in Brazil requires a presence in the national territory. If a migrant with a residence permit is absent from the country for more than 2 years and then returns, he or she must submit a request to justify the reason for his or her period of absence.
What is it?
Obtaining a residence permit in Brazil requires the individual to be physically present in the country. If the migrant, who already has the permit, remains outside the national territory for a period of more than 2 years, it will be necessary to present a justification explaining the reasons for his/her absence.
How to carry out the justification?
Upon returning to the country after 2 years abroad, the migrant will receive a notification from immigration control to clarify the reasons for the period of absence. Unjustified absence may result in an administrative process for loss of residence permit. The defense may be made by a lawyer or by the migrant himself.
Important documents and information
The migrant must gather all documentation that can prove the impossibility of returning to Brazil before the end of the 2-year period. If, for example, the absence was due to work or health reasons, supporting documents must be presented.
